San Marcos requires grading permits for earthwork under SMMC Title 17. Projects must include drainage plans demonstrating that runoff will not adversely affect neighboring properties.
San Marcos regulates grading under SMMC Title 17 (Grading). A grading permit is required for cut or fill exceeding 50 cubic yards, or any grading that alters drainage patterns. Applications are processed through Development Services at (760) 744-1050 x3233 and require engineered grading plans, a soils/geology report for hillside sites, and a drainage study. Drainage plans must demonstrate that post-development runoff does not exceed pre-development rates and does not adversely affect downstream properties. The city's hilly terrain makes proper grading and drainage design critical. Retaining walls over 4 feet in height require separate structural permits. Fill material must be tested and compacted to engineering specifications. Final grading must match approved plans, and as-built certifications are required before occupancy. Projects in or near floodplains must also comply with SMMC Chapter 17.32 (Flood Damage Prevention).
Stop-work orders for unpermitted grading. Restoration of grade to original condition may be required. Fines per SMMC. Code Enforcement at (760) 744-1050 x3234.
