San Marcos enforces California Building Code pool barrier requirements. All residential swimming pools and spas must have a safety barrier at least 60 inches (5 feet) high with self-closing, self-latching gates. Non-climbable barriers and compliant gate hardware are mandatory to prevent child drowning.
San Marcos adopts the California Building Code pool barrier requirements under Title 17 of the Municipal Code. All residential pools and spas must be enclosed by a barrier at least 60 inches (5 feet) in height. Gates must be self-closing and self-latching, with the latch release mechanism at least 54 inches above the ground. Barriers must be non-climbable, meaning no horizontal rails or features that could serve as footholds for children. Openings in the barrier must not allow passage of a 4-inch sphere. The barrier must completely surround the pool with no direct access from the home without passing through a gated barrier (unless approved door alarms are installed). Building permits and inspections are required for new pool barrier installations.
Non-compliant pool barriers may result in code violations, fines, and required corrections. Pool construction without proper barriers may fail final inspection. Contact Development Services at (760) 744-1050 x3233.
