Encinitas enforces the California Swimming Pool Safety Act (Health & Safety Code Sections 115920-115929) and California Building Code Section 3109 for pool barriers. All residential swimming pools and spas must be enclosed by a barrier at least 60 inches in height. Gates must be self-closing and self-latching with latches at least 60 inches above grade on the pool side or with a release mechanism requiring adult knowledge to operate. Barrier openings must not allow passage of a 4-inch sphere. The barrier must be located so that no permanent structure, equipment, or furnishing provides a means of climbing over. Doors from the house that open directly to the pool area must have self-closing devices and alarms that produce an audible sound when the door is opened. At least one additional safety feature is required per California law: a pool cover meeting ASTM F1346, exit alarms on all doors/windows with pool access, or a removable mesh fence meeting ASTM F2286. Spa covers with locking mechanisms meeting ASTM standards may serve as the barrier for spas. Building permits are required for pool barrier installation and inspection by Development Services at (760) 633-2710.
Pool barrier violations are enforced by the Building Division and Code Enforcement at (760) 633-2660. Non-compliant barriers are red-tagged and must be corrected before pool use. Failure to maintain barriers may result in fines and mandatory abatement.
