Hoboken, NJ Environmental Rules: Stormwater Management (2026)

Section 166-2 sets the article's purpose as establishing minimum stormwater management requirements and controls for major development, applying to nonresidential major developments and to the parts of residential major developments not preempted by the state's Residential Site Improvement Standards, within Hoboken's W(RDV), W(N) and I-1(W) zoning districts under the Zoning Map. Section 166-4 requires stormwater measures for major development to provide erosion control, groundwater recharge, and stormwater runoff quantity and quality treatment, tying the erosion control standard to the state Soil Erosion and Sediment Control Act, N.J.S.A.

4:24-39 et seq., and its implementing rules at N.J.A.C. 2:90, while meeting groundwater recharge and water quality standards through green infrastructure best-management practices. Section 166-5 requires every covered major development to incorporate a maintenance plan for its stormwater measures as part of the design. Other sections in the chapter add safety standards for stormwater management basins, requirements for a site development stormwater plan, private storm-drain inlet retrofitting, rules on private salt storage to limit chloride runoff, and a ban on illicit connections into the storm sewer system.

The Hoboken Planning Board adopted the underlying Municipal Stormwater Management Plan on September 3, 2019 as part of the City's Master Plan, and the ordinance itself was most recently amended in its entirety on October 16, 2019 and had its measures and controls article replaced again on July 10, 2024. Applications submitted before July 10, 2024, or between March 2, 2021 and that date, remain subject to the stormwater standards in effect on July 9, 2024, rather than the current text, so the applicable version depends on the filing date.
