The Oakland County Water Resources Commissioner (WRC) adopted new countywide Stormwater Engineering Design Standards effective May 31, 2021. They apply to any development of 1 acre or more that connects directly to an Oakland County drain, stream, underground pipe, or retention pond under WRC jurisdiction, and to projects in communities that have adopted the regional standard to meet their MS4 permit obligations.
The 2021 standards replaced the prior 'Chapter 4' and impose three layered controls: (1) Water Quality Control (WQC) treating runoff from the first 1.0 inch of rainfall; (2) Channel Protection Volume Control (CPVC) for 1.0-to-1.3-inch storms; and (3) Channel Protection Rate Control (CPRC) for the 1.9-inch storm event. The standards also require flood control to the 100-year storm. Engineered stormwater plans must be sealed by a Michigan-licensed professional engineer and submitted to the WRC for review before any earth change begins. Oakland County is a Phase II MS4 permittee under the federal Clean Water Act and Michigan EGLE's MS4 General Permit, and most cities, villages, and townships in the county have adopted the WRC standards by reference to satisfy their own MS4 obligations. Failure to install or maintain stormwater controls can lead to stop-work orders from the WRC and EGLE enforcement under Part 31 of NREPA (MCL 324.3101 et seq.).
WRC may withhold construction approval, issue stop-work directives, and require corrective work at the owner's expense. EGLE may pursue Part 31 NREPA enforcement, including civil fines and injunctive relief, for unpermitted discharges to waters of the state.
