Texas Local Government Code Chapter 252 requires competitive bidding for most municipal purchases over fifty thousand dollars. Senate Bill 13 of 2021, codified at Government Code Chapter 809, prohibits Texas governments from contracting with companies that boycott energy producers. Senate Bill 19 of 2021 imposes similar restrictions for firearms vendors. These laws sharply narrow climate-driven procurement preferences. Plano Purchasing has voluntary preferences for ENERGY STAR equipment and recycled-content paper, but cannot exclude fossil-fuel-aligned bidders. The Plano Sustainability Commission may recommend pilot programs such as fleet electrification.
Awarding a contract that violates SB 13 or SB 19 anti-boycott provisions could trigger Attorney General enforcement, contract voidance, and inclusion of Plano on the state Comptroller restricted-investments list.
