Gaithersburg Section 24-167 establishes general fence standards including height limits, placement rules, and corner lot visibility requirements. Fences do not need to meet building setback requirements but must comply with zoning height limits and permit requirements.
Gaithersburg zoning code Section 24-167 provides the comprehensive framework for fences, walls, and hedges. Building line and yard setback requirements of the zoning chapter do not apply to fences, walls, or hedges, meaning fences may generally be placed at or near property lines. Front yard fences are limited to 3 feet; rear yard fences adjacent to public rights-of-way or alleys are limited to 6 feet. Side property line fences between lots are capped at 6 feet without neighbor consent and city manager approval. On corner lots, a 25-foot sight triangle measured from the intersection of front and side street lines limits all obstructions to 3 feet above curb level. All new fences and alterations require a Residential Fence Permit. The city adopted the Retool Gaithersburg zoning update in July 2024, which comprehensively revised Chapter 24 including fence-related provisions. Fences in historic overlay zones may face additional design review.
Fence not meeting height or location requirements: zoning violation and correction notice. Installation without permit: code enforcement citation. Historic district violations: additional review.
