Gaithersburg Chapter 24 (Zoning) Section 24-167 limits fences to 3 feet in the front yard and 6 feet in the rear yard along public rights-of-way. Side property line fences are limited to 6 feet unless the adjoining owner provides written consent for a taller fence.
Gaithersburg zoning code Section 24-167 establishes fence, wall, and hedge height limits. No fence, wall, terrace, structure, or shrubbery may exceed 3 feet in height in the front yard or 6 feet in height in the rear yard when adjoining a public right-of-way or alley. Along side property lines between different lots, parcels, or tracts, fences and walls are limited to 6 feet. A fence taller than 6 feet may be erected on a side property line only with written consent of the adjoining property owner and approval of the city manager. For corner lots, a sight triangle restriction applies: no fence, wall, or planting over 3 feet above curb level is permitted within 25 feet of the intersection of front and side street lines, to maintain driver visibility. Building line and yard setback requirements do not apply to fences, walls, or hedges.
Fence exceeding height limits: zoning violation subject to correction notice. Installation without permit: building code violation. Corner lot sight triangle violation: safety enforcement action.
