Although no City building permit is required for fences as of June 10, 2021, the 8th Edition (2023) FBC Section 1609 wind-load requirements still apply - Palm Coast (Flagler County) is in the ~140 mph ultimate wind speed zone per ASCE 7-22, and engineered fences (commercial, taller solid privacy walls, masonry walls) should be designed accordingly. Pool barrier fences are reviewed under FBC R4501.17, not under Section 4.01.02. Sunshine 811 (1-800-432-4770) must be called before digging.
Fences with unfinished or untreated ground-contact material, fences in non-approved colors, fences that interfere with drainage, or gates that swing onto a neighbor's property violate Section 4.01.02. Code Enforcement may require correction or removal. Hitting a buried utility because Sunshine 811 was not called exposes the owner to liability under Florida Statute 556.105.
