Effective June 10, 2021, the City of Palm Coast does NOT require a building permit for the installation of a fence; however, a signed acknowledgement of the City Land Development Code regulations is required prior to installation. The signed acknowledgement is logged in the city's permit database as a record of the property owner's commitment to comply with Section 4.01.02 of the Land Development Code. The Building Services Division at City Hall (160 Lake Avenue, (386) 986-3780) issues acknowledgements and may inspect for compliance.
Per the Palm Coast Building Services Fence Regulations document (Part I): 'Effective June 10, 2021, a permit is not required for the installation of a fence, however, an acknowledgement of the City Land Development Code regulations is required to be signed prior to installation.' Once the acknowledgement is completed, a permit record is created in the city's database to retain the signed acknowledgement and the owner may proceed with the project. The Building Department reminds owners that if the property lies within an HOA or has Architectural Review regulations, those rules may be more stringent than the City LDC and HOA approval must be obtained separately. Even though no building permit is required, the fence must still meet all of Section 4.01.02 (height, setbacks, materials, design, prohibited materials). Wind-load compliance with the 8th Edition (2023) Florida Building Code Section 1609 applies to engineered or non-residential fences; Palm Coast (Flagler County) is in the ~140 mph ultimate wind speed zone per ASCE 7-22 (HVHZ does not apply - that is Miami-Dade and Broward only). Pool barrier fences are reviewed separately under FBC Residential R4501.17 and Florida Statute Chapter 515.
Installing a fence without signing the LDC acknowledgement, or installing one that violates Section 4.01.02 (over-height, prohibited material such as barbed wire or razor wire, in front of the front facade outside AGR/EST), may be cited by Code Enforcement and require removal or alteration. Pool barrier fences without a separate permit or that fail to meet FBC R4501.17 cannot be approved at pool final inspection.
