The City of Tustin Community Development Department's user guide for fences, hedges and walls states that fences, hedges and walls must not exceed six feet eight inches (6'-8") in height, unless specifically permitted in a special zoning district, by Variance or Conditional Use Permit, or unless a wall or fence is required for sound attenuation per City and State noise-mitigation policy or other City or State law. This 6'-8" ceiling applies to side and rear yards. In a required front yard setback, the rule is stricter: no fence, hedge or wall over three feet in height may be erected unless specifically permitted by Variance or in a Special Zoning District. Note these are limits measured by the City; the definitions of front, side and rear yard and the size of each required yard depend on the property's zoning district (R1, R2, R3, E4, etc.). Hedges count toward the same height limits as fences and walls. Where a fence, solid hedge or wall in a rear or side yard abuts a street, alley or driveway intersection, it is also subject to the Public Works Department's Intersection Site Distance (corner visibility) standards, which can require lower heights near corners.
Fences exceeding the height limits, or front-yard fences over 3 feet without a Variance, are zoning violations enforced by the City's Code Enforcement Division and can require modification or removal; a Variance or Conditional Use Permit must be obtained before exceeding limits.
