Under OMC Title 17 residential district standards, fence height limits are: within front yard setback areas, fences and walls are limited to 3.5 feet in height; within side and rear yard areas, fences are limited to 6 feet in height; where side or rear yards abut a major arterial street or commercial-zoned property, fences may be up to 8 feet in height. Height is measured from the finished grade on the higher side. Fences on retaining walls have the fence height measured from the top of the retaining wall. Hedges used as fences are subject to the same height restrictions. Within the Old Towne Historic District, fence design and materials may be subject to additional design review requirements.
Fences exceeding height limits may result in code enforcement notices, required height reduction, and fines. Non-compliant fences must be brought into compliance or a variance obtained.
