Georgia does not require neighbors to share boundary fence costs in residential areas. GA Code ยง44-9-1 (Partition Fences) gives rural/agricultural landowners a mechanism to compel cost-sharing of fences between farming parcels, but this rarely applies in suburban Gwinnett. Fences installed without a recorded agreement are owned by whoever paid for and installed them. Gwinnett UDO requires fences to be built on or inside the owner's property line โ not straddling it, absent a mutual agreement. Spite-fence claims are handled under common-law nuisance. A boundary survey is strongly recommended before installation to avoid encroachment disputes.
