Lee's Summit requires the finished side of a fence to face outward toward adjoining properties and streets. In the city each owner maintains their own fence; Missouri's partition-fence statute applies only to rural land.
Lee's Summit's Unified Development Ordinance directs that the finished, or good, side of a fence face outward toward neighboring properties and streets. Within the city there is no cost-sharing mandate; each owner is responsible for their own fence and for keeping structures on their side of the property line. Missouri's partition fence law, MO Rev. Stat. §272.010 to 272.370, provides boundary-fence cost-sharing and fence-viewer arbitration only for agricultural and rural parcels, not urban lots. Confirm the property line by survey before building, and check recorded utility easements that can limit placement. Boundary disputes are resolved in civil court.
Encroachment over a property line is a civil matter resolved by survey and civil remedy. Fences installed backward may draw a compliance notice to reface or reset.
