Louisiana is a civil-law state, so shared-fence rights come from the Louisiana Civil Code, not common-law line-fence statutes. Under La. Civ. Code art. 685, a fence on a boundary is presumed common unless proven otherwise, and neighbors can share upkeep costs.
Unlike common-law states, Louisiana governs boundary fences through the Civil Code. Art. 685 provides that a fence on a boundary is presumed to be common unless there is proof to the contrary, and a landowner may compel adjoining owners to contribute to making and repairing common fences that separate enclosed lands (and, for unenclosed lands, as prescribed by local ordinance). Art. 688 lets a landowner demand that a neighbor trim tree branches or roots that extend across the boundary, at the neighbor's expense, when they interfere with the property's enjoyment. New Orleans layers its CZO height limits on top of these Civil Code rights.
Boundary-fence and trimming disputes are civil matters resolved in Louisiana courts; there is no criminal penalty, but a neighbor can be ordered to contribute to a common fence or to trim encroaching branches.
