Pool fences in Concord must comply with California Health & Safety Code §§115920β115929 (Swimming Pool Safety Act). Pools built or remodeled after January 1, 2007 require at least two drowning prevention safety features, including a 60-inch barrier with self-closing, self-latching gates. Enforcement occurs through Building Division permits and inspection.
Concord enforces California's Swimming Pool Safety Act through its Building Division during pool construction permits and real estate transactions. Health & Safety Code Β§115922 requires residential pools built after January 1, 2007 to have at least two of seven enumerated drowning prevention safety features, which include: (1) an enclosure meeting Β§115923 standards (minimum 60-inch height, self-closing/self-latching gate at 60 inches minimum, no gaps >4 inches); (2) removable mesh pool fencing with self-closing gate; (3) approved safety pool cover; (4) exit alarms on doors providing direct pool access; (5) self-closing/self-latching devices on doors; (6) alarms on the pool water itself; or (7) other approved means providing equal protection. AB 2114 (2018) increased the requirement from one to two features. Real estate sellers must disclose compliance at sale. Spa and hot tub covers meeting ASTM F1346 satisfy the barrier requirement. Homeowner-installed pool fences must be permitted by the Building Division and inspected. Existing pre-2007 pools are grandfathered but strongly encouraged to upgrade.
