For solid pickets or vertical members, spacing between members may not exceed 4 inches at any point. Gates must open outward away from the pool, be self-closing and self-latching, and have a release mechanism located at least 54 inches above grade so it is out of reach of young children; gates must be capable of being locked when the pool is not in use. Above-ground pools may use the pool wall itself as the barrier if the wall is at least 48 inches above grade and the ladder is removable, retractable, or enclosed when not in use. Where a dwelling wall serves as part of the barrier, all doors leading to the pool area must have an audible alarm or other approved access barrier. The barrier must be installed and inspected before the pool is filled, and is verified by the Edison Construction Code Official during the UCC final inspection.
Operating a pool without a compliant barrier is a Chapter 17 violation enforced by Edison Code Enforcement and the Construction Code Official. Penalties include orders to drain the pool until the barrier is brought into compliance, denial of the pool license, daily fines under the Township general penalty schedule, and - because barrier failures are linked to child drownings - potential civil liability under New Jersey premises law.
