A zoning permit from the Edison Zoning Officer is required for any fence under Chapter 37. The application must include a current survey or plot plan showing the proposed fence location and the distances to all lot lines.
Edison Township requires a zoning permit for the construction, replacement, or substantial alteration of any fence on private property. The application is filed with the Township Planning and Zoning Division and includes (1) a completed Zoning Application form, (2) a copy of the property's most recent survey or a plot plan drawn to scale showing the proposed fence, all existing structures, and all lot lines with dimensions, (3) the standard zoning application fee, and (4) a description of fence height and materials. The Zoning Officer reviews the submission for compliance with the Chapter 37 height schedule, the materials provisions of Chapter 37, the corner sight-triangle requirements that protect motorist visibility at intersections and driveways, and any easement or setback restrictions on record. A separate New Jersey Uniform Construction Code (N.J.A.C. 5:23) building permit is generally NOT required for a typical residential fence of 6 feet or less, because UCC Subchapter 2 lists fences not over 6 feet as ordinary maintenance exempt from a construction permit. Fences over 6 feet, masonry walls, and fences used as pool barriers do require a UCC building permit in addition to the Edison zoning permit. The Zoning Officer's determination may be appealed to the Edison Zoning Board of Adjustment.
Installing a fence without the required Chapter 37 zoning permit is a violation that triggers a stop-work order, a notice of violation, and an order either to remove the fence or to file a retroactive application. Continuing violations are subject to the Township general penalty schedule (up to $1,250 per day and up to 90 days community service under N.J.S.A. 40:49-5).
