Edison, NJ Fence Regulations: Fence Permit Requirements (2026)

Edison Township requires a zoning permit for a fence before the Construction Code Official may issue a building permit. § 37-67.3 states plainly that a zoning permit shall be issued by the Zoning Officer before the issuance of any building permit by any Construction Code Official. The Zoning Officer, per § 37-67.1, administers and enforces Chapter 37 and may not grant a permit for any construction that would violate the zoning code.

§ 37-67.4.a.1 groups a fence with the Township's other permitted residential accessory uses, porches, pools, decks, sheds, garages and carports, and sets a flat $100 zoning permit fee for a minor residential alteration that does not change the building footprint or create a bulk violation. The Zoning Permit Application Fee schedule added by Ordinance No. O.2140-2022, codified at § 37-67.4.d, itemizes the fee by structure type: a residential Fences permit is $100, and a Commercial Fence permit on multifamily or nonresidential property is $300.

If construction plans change after the permit issues and the Zoning Officer must reevaluate the project, § 37-67.4.b adds a resubmission fee equal to fifty percent of the original zoning permit fee. § 37-67.4.c cuts the fee in half for low- and moderate-income housing applicants and for public, charitable or religious nonprofit applicants holding federal tax-exempt status under IRC § 501(c) or (d).
