Edison's Chapter 37 (Zoning) caps residential fences at 4 ft in the front yard and 6 ft overall. Up to 8 ft is allowed along a rear lot line bordering a non-residential zone (except OSC), and industrial zones permit up to 10 ft in side and rear yards.
Edison Township regulates fence height through its Land Development Ordinance (Chapter 37, Zoning). In all residential zones (R-AA, R-A, R-BB, R-B, R-C, etc.), the maximum fence height in any required front yard is 4 feet, and the maximum height in side or rear yards is 6 feet. The Zoning Officer treats the front yard as the area between the principal building and the front street right-of-way, so corner lots have two front yards subject to the 4-foot cap. A higher fence (up to 8 feet) is permitted only along a rear property line that abuts a non-residential zoning district, with the exception of the OSC (Open Space and Conservation) zone, where the residential rear-yard maximum still applies. Industrial zones (I-1, I-2) allow fences up to 10 feet in side and rear yards as a security measure. Fence height is measured from finished grade on the higher side of the fence to the top of the fence (including any decorative caps or post finials). Retaining walls are not counted toward fence height unless the wall is integral to the fence system. Pool barrier fencing is governed separately under Chapter 17 (see swimming-pool entries). Variance relief from the height schedule requires application to the Edison Zoning Board of Adjustment under N.J.S.A. 40:55D-70.
Constructing a fence taller than the zone maximum without a variance is a Chapter 37 zoning violation. Penalties include a stop-work order, a notice of violation, and continuing daily fines under the Township's general penalty schedule (up to $1,250 per day under N.J.S.A. 40:49-5 as adopted locally), plus an order to lower or remove the non-conforming portion.
