Section 33-12 of the Miami-Dade County Code establishes safety barrier requirements for swimming pools. No final pool inspection or approval is given without an erected barrier. The minimum height is 48 inches above grade. Acceptable materials include screened-in patios, wooden fences, wire fences (two-inch chain link, nonclimbable type), rock walls, concrete block walls, or other materials blending with architecture. Gates must be self-closing and self-latching with the release mechanism at least 54 inches above grade. FL Β§515 additionally requires at least one supplemental safety feature. In the HVHZ, all barriers must meet hurricane wind load standards.
Missing or non-compliant pool barriers prevent final inspection. Existing pools with deficient barriers are subject to immediate code enforcement. Potential criminal liability if an incident occurs.
