Residential pool barriers in Hendersonville must comply with the City-adopted 2021 International Swimming Pool and Spa Code (effective July 1, 2025). The City of Hendersonville Building & Codes Department adopted the 2021 ISPSC effective July 1, 2025 (replacing the 2018 ISPSC that applied through 6/30/2025). ISPSC Section 305 (Permanent Barrier Requirements) governs residential pool barriers and requires: 'The top of the barrier shall be at least 48 inches (1219 mm) above grade where the measurement is taken on the side of the barrier which faces away from the swimming pool'; the maximum vertical clearance between grade and the bottom of the barrier is 2 inches measured on the side of the barrier facing away from the swimming pool (or 4 inches when the top of an above-ground pool structure is at least 48 inches above grade); 'Openings in the barrier shall not allow the passage of a 4-inch-diameter (102 mm) sphere'; solid barriers shall not contain indentations or protrusions except for normal construction tolerances and tooled masonry joints; where the barrier is composed of horizontal and vertical members and the distance between the tops of the horizontal members is less than 45 inches, the horizontal members shall be located on the swimming pool side and spacing between vertical members shall not exceed 1-3/4 inches; chain-link mesh size shall not exceed 1-1/4 inches square unless slats are installed to reduce openings to 1-3/4 inches. Gates per ISPSC 305.3: shall comply with the barrier requirements; pedestrian access gates shall open outward away from the pool, shall be self-closing and self-latching, and shall be equipped with a locking device; if the release mechanism is located less than 54 inches from the bottom of the gate, it shall be located on the pool side at least 3 inches below the top of the gate and the gate and barrier shall have no opening greater than 1/2 inch within 18 inches of the release mechanism. Where a wall of the dwelling serves as part of the barrier (ISPSC 305.4), doors with direct pool access must have a UL 2017 alarm, an ASTM F 1346 powered safety cover, a self-closing/self-latching device with the release at least 54 inches above the floor, or other approved means. The City's Swimming Pool Plan Submittal Checklist requires the applicant to show 'Pool fencing design and location to show enclosure around pool area' and 'All gates to indicate swing away from pool.' These ISPSC standards operate alongside Tennessee Code Annotated Title 68, Chapter 120 (statewide construction safety floor).
A pool installed without an ISPSC-compliant barrier violates the City-adopted 2021 ISPSC and may result in a stop-use order from Building & Codes (615-822-3802) until a compliant barrier is installed. Common cited violations include failed self-closing gates, latches below 54 inches not located on the pool side, openings larger than 4 inches, barriers under 48 inches, gates that swing toward the pool, and climbable objects (chairs, ladders, AC units, planters) within reach of the barrier. The City may require the pool to be drained or covered until violations are corrected.
