Under Zoning Ordinance Chapter 10.6.3.6, Hendersonville mobile vendors are permitted in all commercial districts only. The Planning Department enforces specific siting standards: minimum 1-acre lot; vendor at least 100 feet from any public street; at least 1,000 feet from any other vendor (groups of up to 3 within 50 ft count as a single vendor); at least 1,000 feet from a permanent business which sells the same items (unless the operator obtains notarized permission on the Mobile Vendor Consent Form, Appendix E of the Zoning Ordinance); maximum 6 one-week periods on a lot per calendar year (consecutive periods allowed); the 20-foot-from-principal-building exception waives the time cap. Tables seating up to 8 persons are allowed with trash receptacles. City Parks or City-owned property operations require permission of the Parks Director or Mayor.
Hendersonville's mobile food vendor siting framework is codified at Zoning Ordinance Chapter 10.6.3.6 and operationalized through the Planning Department's Mobile Vendor Checklist. Required siting standards: (1) Allowed districts β 'mobile vendors are permitted in all commercial districts and must conform to all applicable laws.' Residential districts are not permitted vending sites under the standard Mobile Vendor application. (2) Minimum lot size β 'Does the lot which they are located contain a minimum of one (1) acre?' (3) Street setback β 'Is the mobile vendor going to be a minimum of one hundred (100) feet from any public street?' (4) Separation from other vendors β 'Is the mobile vendor at least one thousand (1,000) feet from any other vendor? NOTE: Except that group of not more than three (3) mobile vendors located within fifty (50) feet of each other shall be considered a single vendor in regard to the one thousand (1,000) foot separation requirement.' (5) Separation from permanent same-item businesses β 'Is the mobile vendor at least one thousand (1,000) feet from a permanent business which sells the same items? NOTE: Exception to this is having notarized permission on the Mobile Vendor Consent Form (Appendix E of the Zoning Ordinance).' (6) Duration cap β 'Mobile vendor cannot occupy a lot or parcel for more than six (6) one (1) week periods during the calendar year. Periods may be consecutive. NOTE: This time limitation shall not apply to a single vendor located within twenty (20) feet of the principal building on the lot or parcel.' (7) Seating and trash β 'Tables seating no more than eight (8) persons may be provided for food vendors, provided trash receptacles are provided and emptied as necessary to maintain a clean and sanitary site. All tables, chairs, and trash receptacles and other items associated with the operation shall be removed by the end of the period.' (8) Business and Health licensing on site β 'Business license must be prominently displayed. Food vendors must also display required Health Department Food Service Permit.' (9) Site access β 'No operation in a location that impedes the ingress to, egress from, or signage of another business or otherwise causes undue interference with access to other businesses or emergency areas, paths, or facilities.' (10) City property β 'Mobile vendors may operate in City Parks or on City owned property with permission of the City of Hendersonville Parks Director or Mayor.' (11) Temporary-use exception β vendors operating in conjunction with other permitted temporary uses (carnivals, circuses, civic/non-profit/religious events, festivals) abide by the temporary-use standards rather than Chapter 10.6.3.6. (12) Short-duration food trucks (β€1 hour per lot) follow the Peddlers Ordinance (Municipal Code Title 9, Chapter 1) instead of Chapter 10.6.3.6 β Peddlers Permit obtained through the City Hall front office at 615-822-1000.
Operating outside a commercial district, on a lot smaller than 1 acre, within 100 ft of a public street, within 1,000 ft of another vendor (without the 3-vendor 50-ft cluster rule), within 1,000 ft of a same-item permanent business (without notarized consent on Appendix E), more than six 1-week periods per calendar year on the same lot (outside the 20-ft-from-principal-building exception), or without the required business license and TDH Food Service Permit prominently displayed are Chapter 10.6.3.6 violations. Park / City-property operation without Parks Director or Mayor permission is also prohibited. Zoning Enforcement: Planning Department 615-264-5316.
