Hours for the use of an amplifier or loudspeaker system will be designated in the permit so issued and the use of such systems shall be restricted to the hours so designated in the permit.' Paragraph (l) - 'The use of mechanical loudspeakers or amplifiers on trucks or other moving or standing vehicles for advertising or other purposes.' (3) Section 11-402(2)(c) provides a permitted-exemption pathway for non-commercial and non-profit loudspeaker use ('reasonable use of amplifiers or loudspeakers in the course of public addresses which are noncommercial in character...sponsored by nonprofit organizations'), but those uses also require a permit from the recorder. (4) Section 11-403(2): 'No person or persons owning, operating, or having the care, custody, or control of any facility located within fifty feet or a residence or of a natural conservation area shall permit to be operated any musical instrument or other entertainment device using amplification unless such music or other entertainment is provided within a totally enclosed structure. Such music or other entertainment may be provided outside of a structure only between the hours of seven a.m. and eleven p.m., except when exempted under provisions of the code as a special event, mass gathering or other permitted activity by the City of its boards or commissions.' Loudspeaker/Loud Noise Permit applications are processed online through the city's CSS portal (css.hvilletn.org) and (per the application form) the city warns: 'Complaints regarding the noise level will not be tolerated. Upon a complaint being heard, your permit, if issued, will be immediately revoked.'
Operating amplified sound without a required Section 11-402(1)(k) loudspeaker permit, or in violation of the time and hour conditions on an issued permit, is a Title 11 municipal offense ($50 maximum fine per occurrence under TCA Sec. 6-54-308) and a basis for immediate permit revocation per the city's stated policy.
