Hendersonville's quiet-hour rule lives in Hendersonville Municipal Code Title 11 (Municipal Offenses), Chapter 4 (Offenses Against the Peace and Quiet). Section 11-402(1)(b) targets radios, phonographs, instruments and amplified sound 'particularly during the hours between 11:00 P.M. and 7:00 A.M.,' and Section 11-402(1)(c) extends the same 11 p.m. to 7 a.m. window to yelling, shouting, whistling and singing on public streets when they annoy or disturb persons in the vicinity.
Title 11 Chapter 4 of the Hendersonville Municipal Code contains three operative sections. Section 11-401 (Disturbing the peace) is the general standard: 'No person shall disturb, tend to disturb, or aid in disturbing the peace of others by violent, tumultuous, offensive, or obstreperous conduct, and no person shall knowingly permit such conduct upon any premises owned or possessed by him or under his control.' The enumerated examples in 11-402(1) name the 11 p.m. to 7 a.m. residential quiet window twice: paragraph (b) covers 'playing of any radio, phonograph, or any musical instrument or sound device, including but not limited to loudspeakers or other devices for reproduction or amplification of sound...particularly during the hours between 11:00 P.M. and 7:00 A.M., as to annoy or disturb the quiet, comfort, or repose of persons in any office or hospital, or in any dwelling, hotel, or other type of residence, or of any person in the vicinity'; paragraph (c) covers 'Yelling, shouting, whistling, or singing on the public streets, particularly between the hours of 11:00 P.M. and 7:00 A.M., or at any time or place so as to annoy or disturb the quiet, comfort, or repose of any persons in any hospital, dwelling, hotel, or other type of residence, or of any person in the vicinity.' Section 11-402 was modified by Ord. 1997-32 (October 1997) and Ord. 1997-33 (September 1997). State law backs the local rule: TCA Section 39-17-308 makes 'disorderly conduct' (including unreasonable noise) a Class C misdemeanor.
Violations of Title 11 Chapter 4 are enforced by the Hendersonville Police Department (non-emergency dispatch (615) 822-1111) and adjudicated in Hendersonville City Court.
