Pool barriers in Jefferson County are regulated under the 2018 Kentucky Residential Code (KRC) Appendix G, enforced by Louisville Metro Codes and Regulations. Any pool, spa, or hot tub with water over 24 inches deep requires a barrier. Minimum barrier height is 48 inches measured from the outside. Gates must swing outward away from the pool, be self-closing and self-latching with the release mechanism at least 54 inches above grade. Horizontal members must be spaced over 45 inches apart or face the pool side to prevent climbing. Openings in vertical fencing must not allow a 4-inch sphere to pass. If the house forms part of the barrier, doors leading to the pool must have alarms that sound within 7 seconds or self-closing/self-latching hardware. Above-ground pools with walls 48 inches high may serve as barriers if the ladder is removable or lockable. Inspection required before final pool permit approval.
Non-compliant barrier: immediate correction required; pool use prohibited. Code enforcement fines $100-$500 per day under LMCO Chapter 32. Drowning incidents create civil liability exposure; KRS Β§411.190 (recreational use) does not shield owners from attractive nuisance claims.
