All residential pools in Westchester County must comply with NYS Residential Code Appendix G (effective May 12, 2020): barrier minimum 48 inches above grade outside the enclosure, self-closing/self-latching gate opening away from pool with latch 40+ inches above grade on pool side, max 2-inch bottom gap, chain link max 2ΒΌ-inch mesh. Pools built or substantially modified after December 14, 2006 require ASTM F2208 pool alarms (NY Executive Law Β§387(14); 19 NYCRR Β§1228.2). Westchester County Department of Health inspects public and semi-public pools; residential pool permits and inspections are handled by municipal building departments.
Per NY Executive Law: up to $5,000 fine and/or up to 15 days jail per day of violation. Pool alarm signage: $500 first offense, $1,000 subsequent.
