Murrieta enforces the California Swimming Pool Safety Act (Health and Safety Code 115920). Pool barriers must be at least 60 inches tall with self-closing, self-latching gates and cannot have openings allowing a 4-inch sphere to pass through.
All residential swimming pools and spas in Murrieta must comply with the California Swimming Pool Safety Act, Health and Safety Code Sections 115920 through 115929. The law requires at least two of seven specified drowning prevention features for any pool that serves a single-family home, and for new pools, pool remodels, or when selling a home with a pool, compliance is verified. The most common feature is an enclosure fence at least 60 inches (5 feet) tall completely surrounding the pool or the property, separating the pool from access to the home. Gates must be self-closing and self-latching with the latch at least 60 inches above the ground or on the pool side out of reach of young children.
Other approved features include removable mesh pool fencing meeting ASTM F2286 standards with self-closing, self-latching gate, an approved safety pool cover (ASTM F1346), exit alarms on doors leading to the pool area, self-closing self-latching devices on doors leading to the pool, approved pool alarms sensing surface motion, or other approved means. Openings in the barrier cannot allow passage of a 4-inch sphere, horizontal members must be spaced to prevent climbing, and there can be no climbable features on the exterior within 45 inches of the ground. Pool permits require compliance verification. Existing HOA pools and multifamily developments have stricter commercial pool code requirements.
