Pool barriers in Menifee are governed by the California Swimming Pool Safety Act, Health & Safety Code §115920 et seq., as amended by SB 442 (effective January 1, 2018). New residential pools and spas, and remodels requiring permits, must include at least TWO of seven approved drowning-prevention features. Menifee Building & Safety enforces these requirements at plan check and final inspection through MMC Title 15 (adoption of the California Building Code).
Per HSC §115922 (amended 2024, effective January 1, 2025), the seven approved features are: (1) enclosure meeting §115923 (minimum 60-inch perimeter fence, self-closing/self-latching gate); (2) removable mesh fencing meeting ASTM F2286 with self-closing/self-latching gate; (3) safety pool cover meeting ASTM F1346-23; (4) door/window exit alarms with audible warning; (5) self-closing/self-latching device on doors providing pool access with release at 54+ inches; (6) ASTM F2208 water-entry alarm (wearable alarms excluded); (7) other approved means meeting equivalent ASTM standard. Certain combinations cannot count as the required two (e.g., an exit alarm plus self-closing device on the same door). Building inspector verification is required before final approval. The fence-perimeter option under §115923 sets specific requirements: 60 inches high, no more than 2 inches above grade, no openings allowing a 4-inch sphere, and gates that open outward away from the pool.
Failure to install two compliant safety features is a code violation enforced by Menifee Building & Safety; final inspection will not be approved. Modification or removal of required features after final inspection is a violation under HSC §115925 and Menifee's adopted CBC. Civil liability and Riverside County code enforcement may also apply, particularly after drowning incidents.
