Jurupa Valley enforces the California Swimming Pool Safety Act (Health & Safety Code §§115920-115929, as amended by SB 442) through Municipal Code Title 8 Chapter 8.25 (Private Swimming Pools). New or remodeled residential pools and spas with water depth over 18 inches must have an enclosure at least 60 inches (5 feet) tall with self-closing/self-latching gates, plus at least two of the seven approved drowning-prevention safety features.
Cal. H&S Code §115921 defines a 'swimming pool' as any structure intended for swimming or recreational bathing containing water over 18 inches deep, including in-ground pools, above-ground pools, hot tubs, spas, and non-portable wading pools, and defines an 'enclosure' as a fence, wall, or other barrier that isolates the pool from access to the home. §115922 (as amended by SB 442, effective Jan 1, 2018) requires NEW or REMODELED pools/spas to incorporate at least TWO of seven drowning prevention safety features: (1) an enclosure meeting §115923, (2) removable mesh fencing meeting ASTM F2286 with a self-closing/self-latching gate, (3) approved safety pool cover meeting ASTM F1346, (4) exit alarms on doors leading to the pool, (5) self-closing/self-latching doors with release 54+ inches above the floor on dwelling doors to the pool, (6) alarms in the pool that detect unauthorized entry, or (7) other approved means of equivalent protection. The §115923 enclosure must be at least 60 inches high (measured from the side facing away from the pool), have a maximum bottom clearance of 2 inches above grade, openings that do not allow passage of a 4-inch sphere, and a self-closing/self-latching gate that opens outward from the pool with the latch at least 60 inches above the ground. Riverside County / Jurupa Valley Building Division guidance further specifies that mesh fencing cannot be the primary barrier, chain link must be at least 11 gauge, and any decorative features must not provide easy footholds. Jurupa Valley's planning rules acknowledge the swimming pool exception in the inter-neighbor fence FAQ: a fence IS required between properties when one has a swimming pool. Permits for the pool, barrier, and any equipment are issued under Title 8 Ch. 8.05/8.25.
Pool barrier violations are enforced by the Building Division and Code Enforcement under Ch. 8.25 and the CBC. Operating a pool without a compliant barrier and required safety features can trigger stop-use orders, draining requirements, administrative citations, and significant civil liability if a drowning or near-drowning occurs. Final inspection on a new or remodeled pool will not pass without the two required safety features and a code-compliant enclosure.
