Florida's Residential Swimming Pool Safety Act (FL Β§515.25 through Β§515.37) applies to all residential pools, spas, and hot tubs. Brevard County Building Department enforces through the Florida Building Code, Chapter 45 and Residential Section R4501.17. Minimum barrier height is 48 inches measured from ground on exterior side. Maximum 4-inch gap at bottom; no gaps wider than 4 inches in fence mesh. Gates must be self-closing and self-latching with latch at minimum 54 inches above ground. House walls serving as barrier require approved door alarms, self-closing doors, or safety pool cover. Above-ground pools with sides 48 inches or higher with removable ladder may qualify. Pools built before October 1, 2000 are exempt unless property changes ownership, triggering 90-day compliance window under FL Β§515.27. HVHZ does not apply to Brevard but hurricane wind loads do.
