Pool fencing is one of the most strictly enforced residential building code items in Parma because of child-drowning risk. The Ohio Residential Code (OAC 4101:8, adopting IRC Appendix G / Section R326) requires every residential pool capable of holding water 24 inches or deeper to be surrounded by a barrier at least 48 inches (4 feet) tall measured from the outside. Gates must be self-closing and self-latching with the latch located at least 54 inches above the ground or on the pool side of the gate inaccessible to small children. Barrier openings cannot exceed 4 inches horizontally, and chain-link fencing as a barrier has maximum mesh size restrictions. Above-ground pools with walls at least 48 inches high can themselves serve as the barrier provided any ladder is removable or lockable. Doors from the dwelling that open directly into the pool area must have alarms or a separate barrier. Parma Building Department inspects pool barriers before water is added and again after installation as part of the pool permit process. Failure to maintain an operational self-latching gate is one of the most common violations found during reinspections.
Missing or non-compliant pool barrier: immediate stop-use order plus $250-$500 fine. Continued non-compliance may result in criminal charges if a drowning injury results. Homeowner civil liability exposure is substantial.
