Cleveland requires every residential swimming pool, spa, or hot tub capable of holding water more than 24 inches deep to be enclosed by a barrier at least 48 inches high, as mandated by Ohio Revised Code Β§3781.102 and the Ohio Residential Code. Barriers must have self-closing, self-latching gates with latches at least 54 inches above the ground. Above-ground pools may use the pool wall as part of the barrier if the wall is at least 48 inches high and the ladder is removable or lockable.
The barrier must completely surround the pool with no openings larger than four inches, and any gaps beneath the fence must be less than two inches. Chain-link fences used as pool barriers must have mesh openings no larger than 1.75 inches or have slats reducing openings to 1.75 inches. Gates must open outward away from the pool and include a self-latching device. When a dwelling wall serves as part of the barrier, doors leading to the pool area must be equipped with an alarm or the pool must have a power safety cover meeting ASTM F1346. Pool barriers must be inspected and approved by Cleveland's Department of Building and Housing before the pool is filled.
Operating a pool without a compliant barrier is a code violation subject to daily fines and orders to drain the pool until compliance is achieved. In cases of drowning or injury, property owners may face civil liability and strict enforcement.
