[§ 358.04(a)] Height and Opacity. Fences in actual front yards and in actual side street yards shall not exceed four (4) feet in height and shall be at least fifty percent (50%) open, except that, in an actual side street yard, a fence that is set back at least four (4) feet from the side street property line may be a maximum of six (6) feet in height and may be open or solid. Fences in actual rear yards and in actual interior side yards shall not exceed six (6) feet in height and may be solid or open. No fence shall be higher than its distance from a residence building on an adjoining lot ... Fences in actual rear yards and actual interior side yards can reach 6 feet and may be open or solid without an opacity test.
A separate cap applies near an adjoining residence: no fence may stand taller than its distance from a residence building on the next lot, or from where a future residence could be placed on that lot, if the fence runs generally parallel and adjacent to the closest wall of that residence. 5 feet is at least 75% open, the same rule applies where a fence runs along a driveway within 15 feet of a sidewalk or street. 04(b).
Violations & Fines
Building or maintaining a fence over these height limits is a Zoning Code violation: under Section 327.99(a), failing to comply with a Director of Building and Housing order to lower or remove an oversized fence is a misdemeanor of the first degree, with each day of noncompliance a separate offense. Section 358.03(b) additionally lets the Commissioner order a nonconforming sight-line fence corrected whenever it creates a demonstrated hazard, though the Board of Zoning Appeals may allow it to stay if no hazard is found.
