Cleveland requires a building permit for any retaining wall over four feet in height measured from the bottom of the footing to the top of the wall, or any retaining wall supporting a surcharge. Plans must be prepared by a licensed Ohio professional engineer for walls over four feet or those retaining soil under load. The Department of Building and Housing reviews permits under the Ohio Residential Code and Ohio Building Code.
Retaining walls must be designed to resist lateral earth pressures and comply with CCO building provisions aligned with the state codes. Walls must be set back from property lines to prevent encroachment, and drainage must be provided behind the wall to prevent hydrostatic pressure. Where a retaining wall exceeds 30 inches above grade and is adjacent to a walkway, a guardrail or fence on top is typically required for fall protection. Segmental block walls over 4 feet require engineered designs. In designated slope or flood-prone areas, additional grading and stormwater review applies. Walls in the public right-of-way or supporting a public sidewalk require separate approval from the Department of Public Works.
Constructing a retaining wall without required permits or engineering can trigger stop-work orders, fines, and orders to remove or rebuild the wall. Failed walls may be declared public nuisances requiring emergency abatement at the owner's cost.
