Parma Codified Ordinance 634.04 Table I sets receiving-land-use decibel caps measured at the property boundary: 60 dBA in residential areas from 8 AM to 9 PM, 50 dBA from 9 PM to 8 AM, 65 dBA at retail at all times, and 70 dBA at industrial at all times. Continuous and impulsive sound levels deemed immediate threats are governed by 634.06 Tables 2 and 3.
Under Section 634.04(a), no person may operate a sound source on private property that exceeds the Table I limit at the receiving land use's property boundary. Section 634.06 sets stricter caps measured at 50 feet from the source for continuous and impulsive sound: 90 dBA over 24 hours up to 108 dBA over 22 minutes, and impulsive sound at 145 dB (1 repetition), 135 dB (10), or 125 dB (100 repetitions) per 24-hour period. Construction, emergency signals, and domestic power tools are exempted from 634.04 by Section 634.05. Refuse trucks and rail locomotives are also exempt.
Section 634.04 violations are minor misdemeanors; willful or knowing violations are fourth-degree misdemeanors. Section 634.06 'immediate threat' violations are automatically M4. Penalties under Parma 698.02: minor misdemeanor up to $150; M4 up to $250 plus 30 days jail.
