Vacaville enforces California's Swimming Pool Safety Act (Health & Safety Code 115921-115929) and California Building Code Section 3109. Every new or remodeled in-ground pool requires at least two of seven approved drowning-prevention safety features. The enclosure must be at least 60 inches (5 feet) tall with no more than 4 inches of clearance at the bottom and self-closing/self-latching gates.
California's Swimming Pool Safety Act, codified at Health & Safety Code 115921-115929 and implemented through California Building Code Section 3109 (adopted under VMC Title 15), applies to every newly constructed or substantially remodeled pool and spa attached to or serving a private single-family home in Vacaville. The Act requires a building permit application for a pool or spa to include at least two of seven drowning-prevention safety features: (1) an isolation barrier separating pool from home meeting CBC 3109.4 specifications, (2) an approved removable mesh pool fence (ASTM F 2286), (3) an approved pool safety cover (ASTM F 1346), (4) exit alarms on all home doors with direct access to the pool, (5) self-closing/self-latching devices on doors providing direct access to the pool, (6) an alarm capable of alerting on water entry, or (7) a swimming-pool alarm meeting ASTM F 2208. The required isolation barrier under CBC 3109.4.1.1 must be at least 60 inches tall measured on the side facing away from the pool, with bottom clearance no more than 2 inches above grade (4 inches over a hard surface). Openings cannot allow passage of a 4-inch sphere. Gates must open outward from the pool, be self-closing and self-latching, with the release mechanism at least 54 inches above the ground. VMC 14.09.200 also requires a 3-foot setback from any property line for pools located in the rear or side yard. The Vacaville Building Division reviews barrier compliance during plan check and final inspection.
Operating a pool without the required barrier or safety features violates Health & Safety Code 115921 et seq. and VMC Title 15 (Building Code adoption). The Vacaville Building Division can withhold Certificate of Occupancy and issue stop-use orders. Drowning incidents at non-compliant pools expose the owner to civil liability under California Civil Code 1714, possible criminal liability under Penal Code 273a (child endangerment), and homeowner-insurance claims-denial. Administrative citations under VMC Title 8 Chapter 8.10 start at $100 and escalate per day uncured.
