Venice Code Ch. 88 (Building Regulations) adopts the Florida Building Code and the Residential Swimming Pool Safety Act (Fla. Stat. Ch. 515). Every residential pool, spa or hot tub must have a 4-foot perimeter barrier with self-closing, self-latching gates opening outward away from the pool.
Fla. Stat. 515.27 requires every residential pool to satisfy at least one of: a 4-foot non-climbable barrier with compliant gates, an approved pool safety cover, an exit-alarm system on every door/window providing direct access to the pool, or self-closing/self-latching devices on doors with the release at least 54 inches from the floor. Venice Building Department, under Ch. 88, enforces compliance at permit issuance and final inspection. The barrier must be at least 48 inches high on the outside, with no openings, gaps, indentations or protrusions that would allow a child to crawl under, squeeze through, or climb over.
Failure to maintain a compliant barrier is a second-degree misdemeanor under Fla. Stat. 515.29, punishable by up to 60 days in jail and a $500 fine, plus mandatory pool-safety education. Code Enforcement Board can additionally impose daily civil fines.
