Residential pool barriers in North Port must comply with the Florida Residential Swimming Pool, Spa and Hot Tub Safety Act (F.S. §515) - barrier at least 4 feet (48 inches) high on the outside, no climbable gaps or protrusions, and separate from the home unless the home meets the door-alarm or self-latching-door requirements.
F.S. §515.29 requires one of four safety features for new residential pools: (1) a pool-barrier enclosure meeting §515.29, (2) an ASTM F-1346-compliant safety cover, (3) exit alarms on every door/window opening directly to the pool, or (4) self-closing, self-latching devices with releases at least 54 inches above the threshold on all doors with direct pool access. North Port's Building Division processes pool barrier permits and requires the Residential Swimming Pool, Spa and Hot Tub Safety Act acknowledgement form (Form 507). Sec. 53-240(BB) of the ULDC governs setbacks and screening for pool facilities.
Failure to install required pool barriers is both a state-law violation under F.S. §515.27 (second-degree misdemeanor, up to 60 days jail) and a local Code Enforcement violation. Liability exposure in drowning incidents is also a major concern.
