Ordinance 2019-15 amended Sec. 53-240(M) of the Unified Land Development Code (ULDC) to allow side- and rear-yard residential fences up to 8 feet high. Front-yard fences are capped at 4 feet if 50% or less opaque, 3 feet if more than 50% opaque - unless set back at least 15 feet from the property line, in which case 8 feet is permitted regardless of opacity.
Sec. 53-240(M)(3) - as rewritten by Ord. 2019-15 (adopted March 3, 2020) - sets the front-yard opacity-driven cap: 4 ft for fences 50% or less opaque, 3 ft for more than 50% opaque. The 15-ft setback exception allows 8 ft regardless of opacity. Side and rear yards not abutting a street can have 8-ft fences. Sport-court fences (racquetball, tennis, basketball) and baseball backstops can be up to 20 ft, with each foot above 15 ft adding a foot of side-yard setback. Fence height is measured from the lowest elevation along the fence line including posts, rails, and embellishments (Sec. 53-240(M)(4)).
Building without a required fence permit, or exceeding height limits, is a Code Enforcement violation with fines up to $500/day before the special master. The City can require removal or modification at the owner's expense.
