Yuba City Municipal Code Title 7, Chapter 11 (Uniform Swimming Pool, Spa and Hot Tub Code) governs pool enclosures locally. Section 7-11.03 requires that every swimming pool be surrounded by a fence, wall, or barrier at least 5 feet in height, with self-closing and self-latching gates. The latch must be located on the pool side of the gate and high enough to prevent unsupervised access by young children. In addition, California Health & Safety Code §115922 (as amended by SB 442, effective January 1, 2018) requires that whenever a building permit is issued for the construction or remodel of a residential pool or spa, the pool must be equipped with at least two of seven drowning-prevention safety features: (1) an isolation enclosure meeting §115923, (2) removable mesh fencing meeting ASTM F2286 with a self-closing/self-latching key-lockable gate, (3) an ASTM F1346-23 safety cover, (4) exit alarms on doors/windows providing direct pool access, (5) self-closing/self-latching devices on house doors with releases at least 54 inches above the floor, (6) an ASTM F2208 pool alarm, or (7) an equivalent independently-verified means of protection. Yuba City Building Division enforces both standards at permit and inspection.
Operating a pool without a compliant barrier is a code violation under Title 7. The City may issue a Notice of Violation requiring barrier installation within a set timeframe; failure to comply results in fines under §1-7.01 ($100/$200/$500 escalating) and possible misdemeanor prosecution. Building permits for new pools will not pass final inspection without two SB 442 safety features documented on the plans, and Certificates of Occupancy can be withheld.
