Cuyahoga County, OH Fence Regulations: Retaining Walls (2026)

Ohio is a state-code state for one-, two-, and three-family dwellings under the Residential Code of Ohio, which is published by the Ohio Board of Building Standards and based on the International Residential Code. RCO R404.4 governs retaining walls and treats 48 inches of unbalanced fill as the threshold above which engineered design (stamped by an Ohio Professional Engineer) is required to address overturning, sliding, foundation pressure, and water uplift. Wall height is measured from the bottom of the footing to the top of the wall. A wall under 48 inches that supports a surcharge - for example, a sloped lawn above, a parking pad, a pool deck, or a structure - is treated as if it were a tall wall and must be engineered. Because Cuyahoga County is fully municipalized along its developed corridor, residential retaining wall permits are issued by the city Building & Housing department where the property sits. Cleveland Building & Housing, Lakewood Division of Building, Cleveland Heights Building Department, Parma Building Department, and the suburban departments each have their own application packets and fees, but all enforce the same RCO R404.4 design and lateral support standards. Many Cuyahoga County cities additionally require a separate zoning review for retaining walls in front yards or near property lines, with typical setback and maximum exposed-face heights set in the local zoning code. Walls within the public right-of-way or supporting a public sidewalk, curb, or street typically require a separate Public Works or right-of-way permit from the city. Walls along the Lake Erie bluff in Bay Village, Rocky River, Lakewood, Bratenahl, or Euclid that act as shore protection - even if also functioning as retaining walls - additionally trigger the ODNR Shore Structure Permit and (for structures below the ordinary high-water mark) a Submerged Lands Lease under R.C. 1506.11. Walls inside a FEMA Special Flood Hazard Area (such as portions of the Cuyahoga, Rocky, Chagrin, and Big Creek floodplains) also require a local floodplain development permit before construction can begin.
