Backyard recreational wood fires in unincorporated Collin County are allowed outside of burn bans when limited to approved containers or contained pits under 3 ft diameter burning only clean wood. No trash burning. Must be attended with hose/extinguisher available and setback 25 ft from property lines where possible.
While TCEQ 30 TAC 111.219 provides exceptions for fires used for recreational or ceremonial purposes (e.g., campfires, cooking), they remain subject to county burn bans. Chimineas, Solo Stoves, and UL-listed fire pits are treated the same as wood-burning pits under burn bans. Smoke must not create a nuisance to neighbors; complaints to Fire Marshal may result in nuisance abatement.
Burning during burn ban: Class C misdemeanor, fine up to 500. Nuisance smoke: citation plus order to extinguish.
