Smoke alarms required in all Texas residential dwellings under TX Health & Safety Code 766.003 and International Residential Code adopted countywide. Landlords must install and maintain working alarms per Property Code 92.251-92.262; tenants responsible for battery replacement after move-in.
IRC R314 requires smoke alarms in each sleeping room, outside sleeping areas, and on every level including basements. New construction since 2014 requires hardwired interconnected alarms with battery backup. Carbon monoxide alarms required where fuel-fired appliances or attached garages exist. Rental units must have alarms tested and working at each new tenancy per Property Code 92.255.
Landlord failure to install/maintain: tenant may seek court order, one months rent plus 100 damages, and attorney fees under Property Code 92.260.
