Solano County Code Chapter 12.5 (Abatement of Fire Hazards) requires owners to keep land clear of dry grass, stubble, brush, rubbish, litter, and other flammable material. In State Responsibility Area (SRA) lands, California Public Resources Code Β§4291 requires 100 feet of defensible space around every habitable structure; in the Local Responsibility Area's Very High Fire Hazard Severity Zones, Government Code Β§51182 imposes the same 100-foot standard. After the 2020 LNU Lightning Complex fires, Solano County and CAL FIRE LNU have intensified inspections.
Chapter 12.5 of the Solano County Code authorizes the county officer charged with fire protection β or the local fire protection district (CAL FIRE LNU, Vacaville Fire Protection District, Suisun Fire Protection District, Cordelia Fire Protection District, Montezuma Fire Protection District, or Rural North Solano FPD depending on location) β to order the clearing of flammable vegetation as a nuisance. Under California Public Resources Code Β§4291, every person who owns, leases, or controls land covered with flammable material in the SRA must maintain a defensible space of 100 feet around every building or structure: Zone 1 (0β30 feet) is the lean-clean-and-green zone with all dead vegetation removed and trees pruned 10 feet from chimneys; Zone 2 (30β100 feet) requires reduced fuels with horizontal and vertical spacing between plants. Zone 0 (0β5 feet) is a state-required ember-resistant zone with no combustible materials. Government Code Β§51182 imposes the equivalent 100-foot standard in LRA Very High Fire Hazard Severity Zones; on February 24, 2025, the State Fire Marshal released updated LRA FHSZ maps for Solano County, which the County Board of Supervisors adopted to begin enforcement in July 2025. Common violations include dry grass over 4 inches near structures, accumulated dead brush, woodpiles within 30 feet of a home, and tree branches overhanging roofs.
If an owner fails to comply with a clearance order, Chapter 12.5 authorizes the County or fire protection district to perform the work and recover reasonable costs as a lien recorded with the County Assessor/Recorder, collected through the next year's property tax bill or by civil action. A Chapter 12.5 violation is a misdemeanor (up to $1,000 / 6 months). Failure to maintain PRC Β§4291 defensible space in the SRA can result in civil penalties of up to $500 for a first offense and up to $1,500 for a second offense.
