New Jersey bans consumer fireworks statewide under N.J.S.A. 21:3-2, so no Atlantic County town — Atlantic City, Brigantine, Ventnor, Margate, Egg Harbor Township, Galloway, or Hammonton — may permit them. The 2017 amendment (P.L. 2017, c.74) legalized only non-explosive, non-aerial devices: hand-held or ground-based sparklers, snakes and glow worms, smoke devices, and trick noisemakers such as party poppers, snappers, and drop pops, for anyone 16 or older. Firecrackers, Roman candles, sky-rockets, bottle rockets, mortars, and any aerial or exploding device stay illegal to sell, possess, or use. On the beaches and boardwalk, only the licensed professional displays put on by the shore towns are lawful.
Selling, possessing, or using illegal fireworks is a disorderly persons offense carrying a fine of up to $500 for a first offense, with seizure of the fireworks and higher penalties for repeat or sale violations.
