The 2017 amendment (P.L. 2017, c.74) legalized only non-explosive, non-aerial devices: hand-held or ground-based sparklers, snakes and glow worms, smoke devices, and trick noisemakers such as party poppers, snappers, and drop pops, for anyone 16 or older. Firecrackers, Roman candles, sky-rockets, bottle rockets, mortars, and any aerial or exploding device stay illegal to sell, possess, or use. Only licensed professional displays are lawful.
Selling, possessing, or using illegal fireworks is a disorderly persons offense carrying a fine of up to $500 for a first offense, with seizure of the fireworks and higher penalties for repeat or sale violations.
