Suffolk County opted in to the 2015 NY State sparkler law and allows the sale and use of ground-based sparkling devices (sparklers, fountains, snakes) to persons 18 and older. All aerial, exploding, and consumer-grade fireworks remain illegal statewide under NY Penal Law 270.00. Neighboring Nassau County has opted out and still bans sparklers.
Under NY General Business Law Article 11-A, counties may authorize sparkling device sales between June 1-July 5 and December 26-January 2. Suffolk County authorized sales by local law, making it one of the few Downstate counties where legal sparklers are available. Firecrackers, bottle rockets, Roman candles, M-80s, and any aerial device remain felonies. The Suffolk County Fire Marshal and town code enforcement run July 4th enforcement sweeps, particularly on the East End and in Pine Barrens-adjacent communities.
