Consumer (1.4G) fireworks are legal in unincorporated Cameron County outside city limits and ETJ under state law. During drought or a burn ban, the Commissioners Court may restrict skyrockets and missiles, and outdoor burning of fireworks, as a Class C misdemeanor.
Texas does not ban consumer fireworks countywide; 1.4G items (fountains, roman candles, firecrackers) may be used in unincorporated areas outside a municipality's limits and extraterritorial jurisdiction. Occupations Code 2154.251 bars igniting fireworks within 600 feet of a church, hospital, asylum, licensed child-care center, or school without written permission. Under Local Government Code 352.051, when the Texas A&M Forest Service finds a Keetch-Byram Drought Index of 575 or greater, the Commissioners Court by order may prohibit or restrict the sale or use of 'restricted fireworks' (skyrockets with sticks and missiles with fins) in the unincorporated area. Cities set their own, usually stricter, rules.
Violating a county fireworks order under LGC 352.051, or the 600-foot rule, is a Class C misdemeanor (fine up to $500). Cities may impose separate penalties.
