DuPage County bans the possession, manufacture, storage, sale, handling, and use of consumer fireworks under Section 5601.1.3 of the adopted Fire Code, reinforcing the Illinois Pyrotechnic Use Act (425 ILCS 35). Only licensed public displays with a permit, bond, and qualified operator are allowed. Sparklers and a narrow list of state-approved novelties remain legal.
DuPage County has adopted the International Fire Code as its county fire code. Section 5601.1.3 of that code makes it unlawful to possess, manufacture, store, sell, handle, or use fireworks within unincorporated DuPage County, except under four narrow exceptions: storage at permitted display sites (Sec. 5604), manufacturing or testing (Sec. 5605), licensed public displays (Sec. 5608), and Division 1.4G consumer fireworks "where allowed by applicable laws, ordinances and regulations." Because the Illinois Pyrotechnic Use Act (425 ILCS 35) bans consumer fireworks statewide, that exception does not authorize residents to buy or use them in DuPage County.
The only items legal for residents are the state-approved novelties listed by the Illinois Office of the State Fire Marshal -- snake or glow worms, smoke devices, trick noisemakers, and wire or wood sparklers under 100g composition. A licensed public display requires a permit, a qualified pyrotechnic operator, a $100,000 bond or equivalent liability insurance (Sec. 5601.2.4), and a minimum site clearance of 25 feet of brush, dry grass, and combustible debris around any storage magazine (Sec. 5604).
Under the Illinois Pyrotechnic Use Act, possession or use of consumer fireworks is a Class A misdemeanor (up to $2,500 fine and 364 days in jail), and sale is a Class 4 felony. The DuPage County Fire Code Official may also seize and dispose of violating materials at the owner's expense under Sec. 5601.7. Local fire protection districts may issue additional administrative citations.
