All consumer fireworks are illegal everywhere in Hampshire County under MGL c.148 §39 — including sparklers. Possession, use, and sale are banned statewide. Only licensed professional displays are permitted.
MGL c.148 §39 bans the sale, possession, and use of all fireworks across Massachusetts, so no Hampshire County community — Northampton, Amherst, Easthampton, South Hadley or any other — permits them. The statute's definition explicitly includes firecrackers, cherry bombs, M-80's, Roman candles, sky-rockets, and sparklers. Devices sold legally across the border in New Hampshire remain illegal the moment they cross into the commonwealth. Only supervised displays licensed by the State Fire Marshal under §39A are lawful. Police may seize fireworks without a warrant, and they are forfeited to the commonwealth on conviction.
Possession or use is punished by a fine of not less than ten dollars nor more than one hundred dollars, plus seizure and forfeiture. Selling fireworks: $100 to $1,000 and up to one year imprisonment.
